I will get right to the 'suggestion' part of this blog:

1)  They are not going to sue you for any supposed debt and,

2)  With a little digging you find in their various BBB replies the statement from them that:  
" Our agency does not report debt on behalf of our client to any consumer reporting agencies."   

This means that they are a toothless tiger and simply rely on badgering supposed debtors until the weak willed decide to pay them something.

DO NOT BE FOOLED:  This firm can do NOTHING but pester you with worthless threatening letters and/or obnoxious phone calls.  

They can't sue and they don't report to credit agencies.

JUST IGNORE THEM.  

Eventually they will stop wasting their time, particularly for small amounts.  If you feel like wasting a stamp drop them a line and tell them you are not indebted to the company they represent and you do not want to hear from them again in the matter.

If they continue after that report them to the BBB as many others have done.

I wanted the auto payment Diana and I set up to be taken care of one day early. I made the payment. The next day they auto drafted (with the same transaction number) anyways. I called to say they charged twice. She argued that I had 2 accounts and I knew what I was doing. (Placing blame on me). This was the first I had been told of multiple accounts. She had no regard for my current living situation. And I couldn't reach the manager Lisa.

The guy who called me was very very rude, started yelling at me, fiserv ( the company I owed money to never contacted me), my bank nfcu told me they do not work with fiserv. This guy would not provide any proof of debt owed, all he asked for was my financial information

I was sent a letter by Joseph Mann Creed dated May 1, 2017 regarding an alleged debt of $335.48 (JMC #*******). However, this debt amount of $335.48 is inaccurate, because their client Hertz has failed to provide the actual cost of repairs bill to me for the single tire damage. As per Hertz's own... Rental Terms below. Rental Terms Damage to the rented vehicle and other vehicles or property "Where it appears to Hertz that the cost of repairing the damage (plus the cost of repairing damage to any other vehicle or property with which the rental vehicle collided) may approach or exceed the amount of the Accident Damages Excess (ADE), Hertz will charge your credit, charge or debit card with the full amount of the ADE. If it later transpires that the actual cost of repairs are less than the ADE, Hertz will promptly credit the difference to your card." I have sent a dispute of debt and request for validation certified letter to Joseph Mann & Creed, delivered 5/18/17 (tracking number USPS ******** ************) and they have refused to sign for the letter (USPS *********** ***********). I am requesting Joseph Mann & Creed acknowledge my letter of dispute of debt and request for validation certified mail. And a billing adjustment for the actual repair cost for the correct amount of the single tire damage. I need the actual repair cost bill from an auto repair shop to satisfy insurance. I also demand Joseph Mann & Creed to remove all entries of this inaccurate debt from Transunion, Equifax and Experian. As well as immediately send a copy of my dispute letter to the original creditor Hertz, so they are also aware that I dispute the debt.

However, I disagree with the documents provided by JMC. The Terms and Conditions I agreed to was to pay for the cost of repairs. Nowhere in the documents provided is the actual cost of repairs for a single tire. Hertz has continually refused to provide the auto shop repair bill for $335.48 to me which my insurance requires.Thank you  very much.

I loved this job, aside from the favoritism and being treated like my life was not important was the breaking point. There is a great potential to make lots of money here if you fall in line and friends with someone in high places. Recognizing Your Debt Collection Rights

When a debt collector contacts you for the very first time, under the Fair Debt Collection Practices Act (FDCPA), they have to follow up with specific information that tells you more about the debt that they’re trying to collect. 

This information must be in writing and must be sent within five days of the first contact. The letter should include the quantity of the debt, the name of the creditor to whom the debt is owned, and certain specific language. 

The letter must inform you that, should youn’t dispute the debt in writing within 30 days, the debt collector will assume the debt is valid. If you dispute the debt, the debt collector is needed to supply you with the name and address of the original creditor, in addition to the amount owed.

In more than 20 years of working together, Tina Pereces has always seen Bill Mann as a can-do kind of guy.

“He’s very cool and collected,” said Pereces, the director of sales and marketing at Joseph, Mann & Creed, an accounts receivable management firm in Twinsburg that Mann helped found in late 2000/early 2001.

Pereces has worked with Mann and the firm’s CEO, Perry Creed, since 1992, when they all worked at a prior collection firm.

“You always know that what something is happening and needs immediate attention, he’s going to get done what needs to get done,” Pereces said of Mann, noting that was one of the reasons she was “willing to go along for the ride” with the launch of the new firm.

She said Mann and Creed both worked for nearly a year without taking salaries, instead plowing the money back into what has become a 75-employee company with annual revenues approaching $6 million.

Mann’s also “a great judge of character,” Pereces said, and has skills that go well beyond what might be seen as traditional CFO functions.

Indeed, the nomination noted that Mann “manages not only finance, but also technology, compliance and is a member of the sales team.” His responsibilities include “all finance and accounting functions, including strategic financial oversight related to budget management, cost-benefit analysis, reporting, efficiency opportunities, system integration and forecasting,” the nomination stated.

Mann also is “the mainstay behind the automation and systems development of our software solutions,” according to the nomination.

While handling such disparate duties, Mann “has maintained stability, managed risk and navigated Joseph, Mann & Creed during a challenging economy and the complicated, ever-changing business environment of our industry,” the nomination stated.

He also “recognized the need to diversify into international markets, which resulted in a partnership (with the) League of International Creditors. To that end, (he offered) guidance to mitigate risk when developing a plan for global efforts in order to comply with today’s changing” economy.

Mann is the former president of the International Association of Commercial Collectors and the current president of the Ohio Receivables Management Association.

He’s also a board member of BBB of Greater Cleveland and the past president and a current board member of the Beachwood Chamber of Commerce.

Is Joseph, Mann & Creed calling you? Here's what you need to know.
Debt is a common part of today’s society. There are few adult Americans who don’t have a mortgage, credit card, student loan, medical bill, or some other financial obligation they are working to pay off. But what happens when someone can’t keep up with the payments due to job loss, illness, or a similar setback? Most times, the account is turned over to third-party debt collectors, who will call and send letters to the consumer in an attempt to settle the debt.
The Fair Debt Collection Practices Act (FDCPA) prohibits collection agents from using abusive or deceptive tactics to get money from consumers. In general, they may not do any of the following while collecting or attempting to collect a debt:
  • Yell, swear, or threaten someone
  • Warn a consumer that they can be arrested or imprisoned if they do not pay
  • Fail or refuse to identify themselves as debt collectors looking to settle a debt
  • Call at inconvenient times, such as before 8:00 a.m. and after 9:00 p.m. in the consumer’s time zone
  • Call someone at their place of employment after being told that the employer does not allow such calls
  • Keep contacting someone who has made a formal request to cease communications
  • Contact someone after receiving a formal request to cease communications
  • Discuss the debt with anyone except the consumer, their spouse, or attorney

Alleged Violations against Joseph, Mann & Creed*

Not every debt collector plays by the rules. Joseph, Mann & Creed is a debt collection agency located in Twinsburg, Ohio. Established in 2000, its employee count falls in the 50 to 99 range. According to records held by PACER (Public Access to Court Electronic Records), this particular debt collector has frequently been sued by consumers who felt that their rights were infringed upon during the collection process.
Gary Neus v. Media Collections, Inc d/b/a Joseph, Mann & Creed
In February 2009, Pennsylvania resident Gary Neus started receiving calls from debt collectors working for Joseph, Mann & Creed about an alleged debt owed for an NSF charge. He later claimed he was told by one agent that he could not dispute this debt without a police report. During the same conversation, which took place on February 23, 2009, the collector, who identified herself as Linda Simpson, allegedly told Mr. Neus that he was a deadbeat who could not pay his bills.
On February 25, 2009 Mr. Neus requested validation of the debt. Two days later, on February 27, a Joseph, Mann & Creed representative confirmed receipt of the validation request. On March 16, 2009 he contacted the agency again and asked for the status of validation, at which time the agent allegedly stated, “Why should I waste my time since you’re not going to pay the debt?” Mr. Neus said that he never did receive validation of the debt.
In the complaint he filed with the US District Court, Mr. Neus and his attorney claimed that the collection notice was misleading by stating “should you choose to voluntarily pay this obligation”, which implied that there could be consequences if the he did not pay the debt.
The complaint accused Joseph, Mann & Creed of acting in a false and deceptive manner that oppressed and abused Mr. Neus, particularly by threatening to take action that it did not intend to take for the purpose of coercing him to pay the debt. These alleged acts constituted violations of the FDCPA, including, but not limited to, violations of §§ 1692c(a)(1), d, d(3), d(5), e, f, and g.
The matter was later settled.
If you receive a call from 1-216-831-5626 a debt collector from the office of Joseph, Mann & Creed is attempting to collect a debt from you. If they speak to you in a demeaning manner and imply that you have no choice but to pay the debt, schedule a consultation with a consumer attorney.
Such hostile and deceptive behavior is illegal under the FDCPA, and a skilled attorney can help you get the compensation you’re entitled to. Although some debt collectors like to think otherwise, owing money does not leave you open to insults and mistreatment. The penalty for acting otherwise is up to $1000 per incident.

There is a lot of favoritism in this company. When my son fell really ill they were more worried about my return date and not if he was okay and if the infection that he had was fatal. Infections in the brain are fatal. At this point I chose m child. It is also very hard to stay focused when you feel continuous pressure on you. Loved the hours just not the atmosphere.
